1. Acceptance of terms

By accessing or using MagicPhotoEraser (the "Service") at magicphotoeraser.com, you agree to these Terms & Conditions. If you don't agree, please don't use the Service. Because the Service is free and requires no account, your use of it constitutes acceptance.

2. What the Service is

MagicPhotoEraser is a free, browser-based tool that lets you remove objects from your own photos using AI that runs entirely on your device. Your images are processed locally and are never uploaded to us. There is no account, no subscription, and no charge.

3. Your responsibilities

You agree that you will:

  • Only edit photos you own or have the right to edit;
  • Not use the Service to create or distribute content that is unlawful, infringing, defamatory, or that violates the privacy or rights of others;
  • Not use the Service to produce misleading or deceptive imagery intended to harm, defraud, or impersonate;
  • Comply with all applicable laws in your use of the Service and any images you create with it.

You are solely responsible for the photos you edit and how you use the results. Since everything happens on your device, what you do with the tool is entirely within your control — and your responsibility.

4. Intellectual property

Your photos remain yours. We claim no ownership of, and acquire no rights to, any image you open or create with the Service — we never even receive them. The MagicPhotoEraser name, website, design, and underlying code are owned by us or our licensors; the project's source code is made available under the license stated in its public repository. Third-party AI models used by the Service are subject to their own respective licenses.

5. No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. AI-based object removal is inherently imperfect: results vary by image, and the tool may produce artifacts or unsatisfactory output. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations. Performance depends on your device and browser.

6. Limitation of liability

To the maximum extent permitted by law, MagicPhotoEraser and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service — even if advised of the possibility of such damages. Because the Service is provided free of charge, our total aggregate liability for any claim relating to the Service shall not exceed USD $0.

7. Third-party links and advertising

The site may contain links to third-party websites and may display advertising on informational pages to keep the Service free. We are not responsible for the content, policies, or practices of any third-party sites or advertisers.

8. Changes to the Service and these terms

We may modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms from time to time; the "last updated" date above reflects the latest version. Continued use after changes constitutes acceptance of the revised Terms.

9. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Any disputes shall be subject to the courts of competent jurisdiction in India.
